
Amendment to the Labour Code 2026 – Quatra Max is ready for the changes
From 1 January 2026, amendments to the Labour Code will come into force, which will significantly affect the way in which length of service is calculated in Poland. This is an important change, especially for people whose career paths have not yet fit into the traditional framework of employment.
According to the amendment, the following will be included in the length of service:
- periods of running a business and cooperating with a person running a business,
- periods of suspension of business activity for the purpose of personal childcare,
- periods of performing a contract of mandate,
- provision of services under an agency or cooperation agreement,
- periods of membership in agricultural production cooperatives and agricultural circles,
- documented gainful employment abroad, regardless of the form of employment.
In practice, these changes mean that many people will gain rights and benefits that were previously unavailable to them, despite often having many years of service.
The following groups in particular can expect to benefit from the new regulations:
- people who have worked for years on the basis of civil law contracts,
- sole traders,
- parents who have suspended their business activities to care for a child,
- people with professional experience gained abroad.
However, the introduction of these changes also brings new challenges for employers, especially HR departments. There will be a need to process and verify additional data and documentation, often from many different sources.
