Information on the processing of personal data

In connection with the implementation of the requirements of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46 / EC (general data protection regulation) (“GDPR”), Sygnity Business Solutions SA (hereinafter “SBS”) informs about the rules of processing your personal data and about your rights.

  1. Administrator indication

The administrator of your personal data is SBS based in Zielona Góra, ul. Dąbrowskiego 12, 65-021 Zielona Góra.

  1. Purposes and legal basis for the processing of your personal data:

If the legal basis for your employment at SBS would be an employment contract, your data will be processed for the purpose of Sygnity to conduct recruitment processes in accordance with the applicable provisions of the labor law, in particular art. 221 of the Labor Code (Article 6 (1) (c) of the GDPR) and in the event of a successful recruitment – in order to perform the contract concluded between you and SBS (Article 6 (1) (b) of the GDPR).

In the event that the legal basis for your cooperation with SBS was to be a civil law contract, your data will be processed in order to conduct recruitment processes by SBS aimed at the implementation of a potential contract that may be concluded between you and SBS (Article 6 (1) (b)) GDPR) and in accordance with the law (Article 6 (1) (c) of the GDPR – in particular tax and insurance regulations).

If it is necessary, personal data provided in the recruitment process may be processed in order to defend or pursue claims in a given dispute procedure. In addition, in some situations it is or may prove necessary to process your data for purposes other than those indicated above, and necessary due to the implementation of the legitimate interests of SBS (Article 6 (1) (f) of the GDPR), in particular for purposes related to with the management and implementation of the job recommendation program, ensuring IT and physical security of SBS, including, in particular, the registration of people entering and leaving or for other legitimate purposes related to the management of human resources of SBS, when applicable, for purposes related to conducting disputes and proceedings before public authorities and other proceedings, including for the purpose of investigating and defending against claims, when applicable, for internal reporting within SBS or within the Sygnity SA capital group, of which SBS is a part, including reporting managerial.

Please be advised that we do not expect you to send more information about you than it results from art. 221 of the Labor Code. The consent to the processing of your personal data in a broader scope than it results from the provisions of applicable law is expressed by the mere fact of sending us recruitment documents (e.g. curriculum vitae, cover letter) containing the aforementioned broader scope of personal data (e.g. image, skills) , interests etc.)

If you consent to the processing of your personal data in future recruitments, we will also take your person into account in subsequent recruitment processes conducted by us (Article 6 (1) (a) of the GDPR). When we match your candidacy to a given process, we will act in accordance with the situations described above.

III. Source of obtaining personal data

In the event that your personal data has not been collected directly from you, SBS informs you that your personal data, i.e. name, surname, contact details, and, if applicable, professional experience, qualifications, other data contained in the CV or cover letters have been obtained from SBS employees as part of the referral program or from SBS recruitment partners to whom you have given / consented to the processing of personal data for recruitment purposes. In some cases, SBS employees or recruiting partners may have obtained your personal data from public sources, i.e. professional, industry social media (e.g. LinkedIn, GoldenLine) and recruitment websites.

  1. Information about the recipients of your personal data

In connection with the processing of personal data for the purposes indicated in point II, your personal data may be made available to the following recipients or categories of recipients:

  • public authorities and entities performing public tasks or acting on behalf of public authorities, to the extent and for purposes resulting from legal provisions, e.g. the National Labor Inspectorate, the Tax Office, the Social Insurance Institution, units of the occupational medicine service;
  • entities related to SBS, including within the Sygnity S.A. capital group, in the implementation of recruitment processes
  • entities supporting SBS in its business processes, including entities processing personal data for SBS (so-called data processors).
  1. Periods of personal data processing

Your personal data will be processed for the period necessary to achieve the purposes indicated in point II, i.e. for the duration of the recruitment process (depending on the recruitment process, the period of data processing may last until the end of a given recruitment).

In the event of claims or the need to pursue them, your data will be processed additionally for the duration of the proceedings. .

If you consent to the processing of data, in particular for the purposes of future recruitment processes, your personal data will be processed for 3 years from the date of consent, unless the consent is withdrawn earlier.

  1. Rights of the data subject

SBS would like to ensure that all persons whose personal data are processed by SBS have the appropriate rights under the GDPR. Therefore, you have the following rights:

  • the right to access your data and receive a copy of it;
  • the right to request rectification (correction) of personal data;
  • the right to limit the processing of personal data;
  • the right to delete personal data;
  • the right to transfer personal data if the data is processed on the basis of your consent;

VII. The right to object to the processing of personal data

If the legal basis for the processing of personal data is Art. 6 sec. 1 lit. f GDPR, you have the right to object to such processing to the Data Administrator.

VIII. The right to withdraw consent to the processing of personal data

To the extent that you have given your consent to the processing of personal data, you have the right to withdraw it. Withdrawal of consent does not affect the lawfulness of data processing, which was made on the basis of consent before its withdrawal.   1. The right to lodge a complaint with the supervisory authority

If you believe that the processing of your personal data by SBS violates the provisions of the GDPR, you have the right to lodge a complaint with the competent supervisory authority, which is the President of the Office for Personal Data Protection.

  1. Transferring personal data to entities outside the European Economic Area (“EEA”) or international organizations

SBS informs that it does not transfer data to entities outside the European Economic Area.

  1. Information on the requirement to provide data

Providing personal data – as part of the ongoing recruitment procedure aimed at concluding an employment contract – to the extent resulting from art. 221 KP is necessary to participate in the recruitment procedure. Providing other data is voluntary.

Providing personal data – as part of the ongoing proceedings to conclude a civil law contract – to the extent resulting from the content of the civil law contract is necessary to participate in the recruitment procedure. Providing other data is voluntary.
